How to Start a Sober Living Home in Colorado

October 13, 2026

To start a sober living home in Colorado in 2026, a recovery residence generally must be certified by the state’s approved third-party certifying body. Colorado has also enacted a new Behavioral Health Administration license that begins July 1, 2027, so operators opening now need a plan for both requirements.

This is exactly why state guides need current sources. An article written before June 2026 can accurately describe certification and still miss the licensing system that is now becoming law.

Colorado’s current certification requirement

Colorado law requires a recovery residence to hold third-party certification before operating, except for a narrow legacy category: residences that had already operated in Colorado for at least 30 years as of May 23, 2019.

The state created that structure to connect sober living homes with recognized quality standards and give the Behavioral Health Administration an enforcement role. In 2024, Colorado also authorized cease-and-desist action against recovery residences operating unlawfully.

What changes on July 1, 2027?

SB 26-113 became law in June 2026. Beginning July 1, 2027, recovery residences must obtain a license from the Colorado Behavioral Health Administration. The law directs the BHA to establish application procedures, minimum operating standards, and reporting obligations.

The new framework includes reporting for serious events such as resident deaths, specified injuries, abuse or neglect, misappropriation of property, and diversion of a resident’s medication. The detailed rules will matter, so an operator shouldn’t wait until the deadline to learn how the process works.

Colorado treats sober living as residential land use

Colorado’s 2024 law declares recovery residences, sober living facilities, and sober homes to be residential uses of land for zoning purposes. That is meaningful protection against treating a home as an unrelated commercial use simply because residents are in recovery.

It doesn’t mean every house or every resident count automatically works. Local governments can still apply lawful residential health and safety requirements. Confirm the exact property, proposed capacity, parking, building classification, and fire obligations before committing.

Residential use is an important starting point, not the end of property due diligence. Get the local answer in writing and identify the code section behind it.

Certification should match the real operation

A certification application usually examines more than the physical house. Expect standards around resident rights, ethics, medication, governance, safety, finances, complaints, staffing, training, and recovery support.

The documents need to match daily practice. A polished policy manual won’t protect residents or the operator if managers use a different set of rules once the home opens.

Keep housing and treatment distinct

A sober living home can connect residents with treatment and community services without providing clinical care itself. If the business will assess, diagnose, counsel, administer treatment, or provide another regulated behavioral-health service, confirm whether additional licensing applies.

Define the model first. That decision affects staffing, insurance, marketing language, resident intake, records, property, and the agency responsible for oversight.

A practical order for opening in Colorado

  1. Choose whom the home will serveThe population and support level shape every later decision.
  2. Research demandIdentify the local organizations and people already helping that population find housing.
  3. Confirm certification and licensingMeet the current requirement and build a transition plan for July 2027.
  4. Verify the propertyReview zoning, occupancy, fire, bedrooms, parking, insurance, transportation, and economics.
  5. Prepare the operationBuild lawful resident agreements, policies, staffing, safety, complaints, and incident procedures.
  6. Complete approvals before openingDon’t rely on projected resident income until the home can legally and safely operate.

Colorado markets won’t all behave the same

Denver, Colorado Springs, Fort Collins, Pueblo, Grand Junction, and mountain communities have different rents, transportation, treatment networks, local politics, and resident needs. Strong statewide demand doesn’t prove demand at a particular price in a particular neighborhood.

Learn where residents actually come from, then use that research while choosing the property. The home’s capacity also needs its own review; read what determines a defensible resident count.

For the broader legal landscape, use the requirements-by-state hub. Then return to current Colorado sources before submitting an application or signing an unconditional property agreement.

Frequently asked questions

Do sober living homes need certification in Colorado?

Current Colorado law requires recovery residences to be certified by an approved third-party certifying body, with a narrow exception for homes that had operated for at least 30 years as of May 23, 2019.

Will Colorado require a state recovery-residence license?

Yes. SB 26-113 became law in 2026 and requires Behavioral Health Administration licensure beginning July 1, 2027. Operators opening now should track the implementation rules.

Who certifies Colorado recovery residences?

Colorado selected a third-party certifying body under its recovery-residence law. Confirm the current approved body and application standards before applying.

How does Colorado treat sober living for zoning?

Colorado’s 2024 law declares recovery residences, sober living facilities, and sober homes to be residential uses of land for zoning purposes. Local health, safety, building, and occupancy rules may still apply.

Can a Colorado sober living home provide treatment?

A housing-only recovery residence should not provide unlicensed clinical treatment. Services determine whether separate behavioral-health licensing applies.

What should a Colorado operator do before July 2027?

Meet the current certification requirements, follow applicable state and local rules, and monitor BHA licensing regulations so the home can transition before the new deadline.
